TERMS OF USE



Acceptance of Agreement

  1. Thank you for visiting the Ministry of Education (“MOE”) Learning & Development Portal on Professional Development, OPAL2.0 (which stands for One Portal All Learners 2.0). You are required to read, acknowledge and agree to the Terms of Use upon the initial login in order to be granted access to OPAL2.0. If you do not agree to the Terms of Use, please do not access or use OPAL2.0.

  2. MOE reserves the right to change these Terms of Use from time to time at its sole discretion. All changes will be posted on this page, and your continued use of OPAL2.0 after such changes have been posted will constitute your unconditional agreement to the modified Terms of Use.

User’s Responsibility

  1. You agree to use OPAL2.0 only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of OPAL2.0. Prohibited behaviour includes harassing or causing distress to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within OPAL2.0.

  2. MOE reserves the right to log off or deactivate accounts that are inactive for 30 minutes or longer on a Web browser or inactive for 90 days or longer on the OPAL2.0 mobile application. MOE reserves the right to immediately deactivate or terminate any accounts that have breached any part of the Terms of Use.

Contributions and Submissions

  1. Where you upload or post any content (the “Uploaded Content”), whether original or otherwise, to OPAL2.0 (including any text, photograph, graphics, shockwave flash object, software, computer code, video or audio material), you warrant that you have the right to grant and you agree to grant MOE a perpetual, worldwide, non-exclusive, sub-licensable, royalty-free licence to copy, reproduce, modify, adapt, translate, create derivative works from, distribute, perform, play, make available to the public, communicate, publish and distribute, and exercise all copyright and publicity rights with respect to the Uploaded Content worldwide and/or to incorporate the Uploaded Content in other works in any media now known or later developed for the full term of any rights that may exist in the Uploaded Content, and in accordance with privacy restrictions set out in the Privacy Statement for OPAL2.0. If you do not have the right to grant or do not want to grant to MOE the rights set out above, please do not upload or post the content to OPAL2.0.

  2. By uploading or posting any content to OPAL2.0, you

    1. warrant and declare that the Uploaded Content:
      1. is your own original work or is properly licensed from a third party, and that in any event you hold a copyright licence for the Uploaded Content, and that you have the right to make it available to all users of OPAL2.0 for the purposes specified above;

      2. is not defamatory;

      3. does not infringe any law; and

    2. agree to indemnify MOE against all legal fees, damages and other expenses that may be incurred by the MOE as a result of your breach of the above warranty; and

    3. waive any moral rights1 in the Uploaded Content for the purposes of its submission to and publication on OPAL2.0 and the purposes specified above to the fullest extent permitted by law.

  3. MOE reserves the right to access or examine any content uploaded or posted to OPAL2.0 whether this content is public or not. MOE reserves the right in its sole discretion to move, remove or disable access to any content.

  4. MOE reserves the right in its sole discretion to disable any link to or frames of any site, including any site containing inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful content, or content that violates any person’s rights to property, intellectual property, privacy or publicity.

Intellectual Property Rights

  1. The copyright and other intellectual property rights in all content uploaded on OPAL2.0 (the “Content”), as well as in the design, source codes, graphics, audio and video of and on OPAL2.0 are owned by, licensed to or controlled by MOE or third parties as the case may be. Save as expressly provided, nothing in these Terms of Use shall be construed as conferring by implication, estoppels or otherwise any licence or right to use any trademark, patent, design right or copyright of MOE or any other third party.

  2. Subject to these Terms of Use, MOE hereby grants all users a personal, nontransferable, non-exclusive, non-sub-licensable right and licence to use the Content, solely for non-commercial educational purposes.

  3. Except as otherwise provided in the Terms, no part of OPAL2.0 or the Content may be copied, reproduced, republished, downloaded, posted, broadcasted, communicated, transmitted, made available to the public, adapted, altered or otherwise modified for any purpose whatsoever without MOE’s prior written permission which may be granted subject to terms.

Disclaimers

  1. Third Party Disclaimer. OPAL2.0 may include hyperlinks to other websites which are not maintained by MOE. MOE is not responsible for the contents of or reliability of such websites and does not endorse any content or material on such websites. MOE has no control over and cannot guarantee the accessibility or proper functioning of those websites. Use of the hyperlinks and access to those websites are entirely at your own risk.

  2. Content Disclaimer. The Content is provided on an “as-is, where-is” basis without warranties of any kind. While every care is taken by MOE in providing the Content or functions linked to or from OPAL2.0, MOE will not be liable for any loss of damage:

    1. that you may incur from using OPAL2.0;

    2. that you may incur on account of using or visiting any application or service linked to or from OPAL2.0 or relying on any statement, opinion, representation or information in OPAL2.0;

    3. that you may incur arising from any inaccuracy or incompleteness in, or errors or omission in the information on OPAL2.0;

    4. resulting from any delay in the operation or transmission, communications failure, Internet access difficulties or malfunctions in equipment or software; or

    5. arising or resulting from the conduct or the views of any person who accesses or uses OPAL2.0 or any application or service linked to or from OPAL2.0.

  3. You are expected to use your professional discretion in ascertaining if a shared resource contributed is fit for use as it may not be reviewed. MOE is not liable for the accuracy of the resource content at any given point in time.

  4. Risk Disclaimer. To the fullest extent permitted by law, MOE does not warrant and hereby disclaim any warranty:

    1. as to the accuracy, correctness, adequacy, fullness, reliability, timeliness, noninfringement, title, merchantability or fitness for any particular purpose of the Content; and
    2. That the Content available on OPAL2.0 or any functions associated therewith will be uninterrupted or error-free, or that defects will be corrected or that OPAL2.0 is and will be free of all viruses or other malicious destructive or corrupting code, agent, program or macros of other harmful elements.

  5. MOE, its officers, agents, and employees shall not be liable for any damages or loss of any kind caused as a result (whether direct or indirect) of the use of OPAL2.0, or nonaccess thereof, including but not limited to any damage or loss suffered as a result of reliance on the Content contained in or available from OPAL 2.0.

  6. Where appropriate, MOE uses available technology to protect the security of communications made through OPAL2.0. However, MOE is not liable for any breaches of the security, integrity or confidentiality of any transactions and other communications made through OPAL2.0. Internet communications may be susceptible to interference or interception by third parties. Despite best efforts, MOE makes no warranties that OPAL2.0 is or will be free of infection from computer viruses or other unauthorised software, and MOE accepts no liability in connection with any loss you may suffer due to such computer viruses or unauthorised software. You are responsible for implementing sufficient procedures and virus checks to satisfy your requirements for the accuracy and security of data input and output.

  7. You agree and understand that you are responsible for any damage suffered by any person, corporation or entity as the result of any remarks, information, feedback or other content submitted by you or made available by you on OPAL2.0. We will not be responsible for damage of any kind arising out of or in connection to any remarks, information, feedback or other content submitted by you or made available by you on OPAL2.0.

IT Security

  1. You agree to comply with the MOE End User ICT Security Policy2. In particular, please pay attention to the following:

    1. Adopting a good personal password is the most important barrier to unauthorized access into a computer system. Each end user is ultimately responsible for all activities carried out under his or her user account. Hence, your OPAL2.0 password shall be kept confidential and private, i.e. not coded into programs, written down or disclosed via email, phone or fax or stored on-line on your MOE Government Furnished Equipment or Personal Computer.

    2. The default/ given/ issued password shall be changed upon first logon. Easy-toguess passwords (e.g. account ID, username, common names, dictionary words, user’s name, birth date, NRIC number) shall not be used.

    3. You shall choose and use passwords that comply and adhere to the password policies set in OPAL2.0, which shall be in compliance with the latest version of the MOE User ICT Security Policy.

    4. You shall not misuse your user account or the OPAL2.0 system. Misuse may lead to deactivation or termination of a given account, and can be the basis for disciplinary actions. Acts of misuse minimally include the following:

      1. Using OPAL2.0 to post statements that are defamatory or constitute personal attack;

      2. Using OPAL2.0 to post potentially offensive information that would impinge on another’s culture, ethics, morality, and religion;

      3. Sending offensive or seditious material to other people;

      4. Knowingly uploading offensive or seditious material;

      5. Sending advertisements, chain letters or other unsolicited messages;

      6. Engaging in marketing, investment activities or other activities that would result in personal financial gain;

      7. Making commercial solicitations including tontines and pyramid schemes for yourself or others;

      8. Uploading software and material that violates copyright laws;

      9. Knowingly uploading a program intended to damage or place excessive load on a computer system or network. This includes computer viruses, Trojans, and worms; and

      10. Attempting to circumvent data protection schemes or uncover security loopholes.

  1. You agree that you will not

    1. use any robot, spider, other automatic device, or manual process, to monitor or copy any part of OPAL2.0 or its contents without MOE’s prior written permission;

    2. use any device, software or routine to interfere or attempt to interfere with the proper working of OPAL2.0; and

    3. take any action that imposes any unreasonable or disproportionately large load on the servers of MOE or MOE’s contractors.

Governing Law


  1. These Terms of Use and the use of OPAL2.0 are governed by and construed in accordance with the laws of the Republic of Singapore. You agree that any claim, legal proceeding or litigation relating to or arising in connection with OPAL2.0 will be brought solely in Singapore, and you consent to the exclusive jurisdiction of the Singapore Courts.
